Terms and Conditions

1. Agreement to these Terms

These Terms and Conditions ("Terms") govern your access to and use of the Park Bench website, applications, events, and related services (collectively, the "Service"). By creating an account, purchasing any product or event ticket, attending an event, or otherwise using the Service, you agree to be bound by these Terms, our Acceptable Use Policy, Privacy Policy, and Refund Policy, each set out in this document.If you do not agree to these Terms, do not use the Service.

2. Eligibility — 18 and older only

The Service is intended solely for individuals who are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater). By using the Service, you represent and warrant that you meet this requirement.We do not knowingly permit any person under 18 to register or attend our events, and we prohibit any use of the Service involving minors. If we learn that a user is under 18, we will terminate the account immediately. If you believe a minor is using the Service, contact us at [email protected] so we can investigate and remove the account.

3. Nature of the Service

Park Bench is a dating network for New Yorkers. Membership in the network is what gives members access to Park Bench’s in-person offerings — hyperlocal, curated gatherings where members meet each other in person in a third space. The network exists to define and limit who may attend our events; we do not charge for network membership itself. Park Bench is not an escort service, an adult-content platform, or a provider of any sexual services, and the Service may not be used to offer, solicit, arrange, or pay for any such services (see Section 5 and our Acceptable Use Policy). We do not guarantee any particular outcome from your use of the Service or your attendance at any event.

4. Accounts and account security

To use most features you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use. We may require identity verification and may refuse, suspend, or terminate any account at our discretion, including to protect the safety and integrity of the community.

5. Prohibited conduct — zero tolerance for exploitation and abuse

You agree that you will not, and will not attempt to, use the Service to:

  • Engage in, facilitate, promote, or in any way further human trafficking, including sex trafficking, forced labor, or the sexual exploitation of any person. We have zero tolerance for human trafficking in any form.

  • Sexually exploit, abuse, or endanger any person, or aid, abet, encourage, solicit, or provide instructions or assistance for the abuse, exploitation, coercion, stalking, or harm of any person.

  • Involve, depict, solicit, or endanger any minor in any way, including the creation, solicitation, transmission, or possession of child sexual abuse material (CSAM). We report suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.

  • Offer, solicit, arrange, advertise, or pay for prostitution, escort services, or any commercial sexual activity.

  • Harass, threaten, defame, intimidate, or stalk any person, or engage in hate speech or incitement of violence.

  • Impersonate any person or entity, or misrepresent your identity, age, or affiliation, or create accounts using false information.

  • Engage in fraud, scams, phishing, or extortion, or any scheme to obtain money, financial information, or anything of value from another user through deception.

  • Solicit money, financial account details, gift cards, cryptocurrency, or investments from other users.

  • Transmit unsolicited advertising, spam, or malware, or content that infringes intellectual property or privacy rights.

  • Post, share, or transmit non-consensual intimate imagery, or any sexually explicit content prohibited by our Acceptable Use Policy.

  • Violate any applicable law or regulation, or any right of any third party.

Violation of this Section may result in immediate termination without refund and referral to law enforcement.

6. Safety, reporting, and moderation

Your safety matters to us. We provide tools to block and report other users, and our events are subject to community guidelines. We investigate reports and may remove content, suspend or terminate accounts, and cooperate with law enforcement. We nonetheless cannot guarantee the conduct of any user; you interact with other users and attend events at your own risk and should exercise caution, especially when communicating off-platform or meeting in person. Please review our Acceptable Use Policy before attending any event or arranging any meeting. To report a concern, email [email protected].

7. Purchases and event tickets

Certain features and events require payment. All pricing, event descriptions, and what each purchase includes are disclosed at the point of purchase and in the Pricing section of this document. Event tickets are one-time purchases. Payments are processed by our third-party payment processor(s); by purchasing, you also agree to the processor’s applicable terms.You authorize us and our payment processor to charge your payment method for the amounts disclosed to you at the time of purchase. Our refund terms, including our satisfaction guarantee for events, are described in the Refund Policy in this document.

8. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms or to protect users or the Service. Sections that by their nature should survive termination (including Sections 5, 11, 12, 13, and 14) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any event or interaction will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, Park Bench and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the [12] months before the claim or (b) [USD $100]. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold Park Bench harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or any law or third-party right.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. 

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting the updated Terms with a new effective date or by email). Your continued use after the changes become effective constitutes acceptance.

Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of and incorporated into the Park Bench Terms and Conditions. It describes conduct and content that are prohibited on the Service and at our events. By using Park Bench, you agree to follow this AUP. Violations may result in content removal, account suspension or termination, removal from or denial of entry to events, forfeiture of any fees paid, and referral to law enforcement.

1. Who may use the Service

You must be at least 18 years old to use Park Bench or attend our events. Accounts or event attendance involving minors in any way are strictly prohibited and will be removed and reported.

2. Zero-tolerance prohibitions

The following are strictly prohibited and enforced with a zero-tolerance policy. We report suspected criminal activity to law enforcement, and suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC).

  • Human trafficking and sexual exploitation. Engaging in, facilitating, promoting, advertising, or furthering human trafficking, sex trafficking, forced labor, or the sexual exploitation of any person.

  • Abuse and endangerment. Aiding, abetting, encouraging, soliciting, instructing, or facilitating the abuse, exploitation, coercion, or physical or sexual harm of any person.

  • Child safety. Any content or conduct that sexualizes, endangers, or involves a minor, including CSAM, grooming, or attempts to contact or meet a minor.

  • Non-consensual and exploitative sexual content. Sharing or threatening to share intimate images without consent, "sextortion," voyeurism, or any non-consensual sexual content.

3. Prohibited commercial and sexual-services activity

Park Bench is a dating network whose paid product is access to in-person events; it is not an adult or sexual-services platform. You may not use the Service to:

  • Offer, solicit, arrange, advertise, or pay for prostitution, escort services, paid companionship, or any commercial sexual activity.

  • Post, transmit, or link to pornography or sexually explicit material.

  • Advertise, promote, or sell any goods or services, run commercial solicitations, or use the Service or our events for any business purpose not authorized by us.

4. Prohibited harmful conduct

You may not:

  • Harass, bully, threaten, intimidate, stalk, or defame any person.

  • Post hate speech or content that promotes discrimination or violence against any individual or group.

  • Impersonate any person or entity, or misrepresent your identity, age, photos, location, or affiliation.

  • Engage in fraud, scams, or phishing; solicit money, financial-account details, gift cards, cryptocurrency, or investments from other users.

  • Post another person’s private or identifying information without consent ("doxxing").

  • Distribute spam, malware, or unsolicited advertising, or attempt to circumvent our security, rate limits, or moderation.

  • Scrape, harvest, or collect other users’ data, or use bots or automated means to access the Service without our permission.

  • Infringe any intellectual-property, privacy, or other right of any third party.

  • Violate any applicable law or regulation.

5. Prohibited content

You may not post content affiliated with our network or featuring members or activities from our network that is illegal, sexually explicit, violent or gory, harassing, hateful, deceptive, or that promotes self-harm or the activities prohibited above.

6. Reporting violations

If you see a violation of this AUP, report it using our in-Service reporting tools or email [email protected]. To report an emergency or an immediate threat to someone’s safety, contact your local emergency services first.

7. Enforcement

We may investigate suspected violations and take any action we deem appropriate, including removing content, limiting features, suspending or terminating accounts without refund, removing attendees from events, preserving and disclosing information as described in our Law Enforcement Guidelines, and cooperating with law enforcement.

8. Changes

We may update this AUP from time to time. Continued use after an update constitutes acceptance of the revised AUP.

Pricing


Park Bench is a dating network for New Yorkers. Membership in the network gives members access to our in-person events, and access to those events is our sole paid product; we do not charge for network membership itself.

How pricing works

Tickets are sold on a per-event basis. The price for each event is shown on that event’s registration page and again at checkout, so you always see the full price before you complete your purchase. All prices are in U.S. dollars (USD) and exclude any applicable taxes, which are calculated and displayed at checkout.

Payment and refunds

  • Event tickets are one-time purchases; there is no subscription or automatic renewal.

  • We accept major credit and debit cards and any other methods shown at checkout. Payments are processed securely by our third-party payment processor(s).

  • Non-refundable, with a satisfaction guarantee. Tickets are non-refundable, but if you attend an event and are not satisfied, we offer a money-back guarantee — contact us within [7] days after the event for a refund. See the Refund Policy in this document for full details.

Refund Policy

This Refund Policy is part of the Park Bench Terms and Conditions and explains how payments and refunds work for our events.

1. Pricing

Event tickets are sold on a per-event basis. The price for each event, and what the ticket includes, is shown on that event’s registration page and at checkout before you complete your purchase. All prices are in U.S. dollars (USD) unless stated otherwise, and applicable taxes may be added. Payments are processed by our third-party payment processor(s).

2. Event tickets are non-refundable

Event tickets are one-time purchases and are non-refundable. Because we plan capacity, venues, and hosting around the number of tickets sold, we do not offer refunds for cancellations, no-shows, or unused tickets, except as provided in Section 3 (our satisfaction guarantee) or as required by law.

3. Satisfaction guarantee (money-back guarantee)

We stand behind our events. If you attend an event and are not satisfied with your experience, contact us at [email protected] within [7] days after the event and we will refund the price you paid for that event. To use the guarantee, you must have attended the event and must request the refund within the window above. This guarantee is our discretionary commitment to attendee satisfaction and is in addition to any rights you have under applicable law.

4. Events we cancel or reschedule

If we cancel an event, you will receive a full refund. If we reschedule an event and you cannot attend the new date, you may request a full refund. We will notify you of any cancellation or change as soon as reasonably possible.

5. How refunds are issued

Approved refunds are issued to the original payment method within [5–10] business days, though the time to appear on your statement depends on your bank or card issuer.

6. Statutory rights

Nothing in this Policy limits any right you have under applicable consumer-protection law. [Confirm which specific statutory rights apply to your events and location with counsel and describe them here if required.]

7. Chargebacks

If you have a billing concern, please contact us first at [email protected] — we can usually resolve issues quickly, including honoring our satisfaction guarantee. Filing a chargeback without contacting us may result in suspension of your account while the dispute is reviewed.

8. Changes to this Policy

We may update this Policy from time to time and will post the updated version with a new effective date. Changes apply to purchases made after the effective date.

Law Enforcement Guidelines

Park Bench is committed to user safety and to cooperating with law enforcement while protecting our users’ privacy and legal rights. This section explains how law enforcement and other government agencies can request information from Park Bench and how we handle those requests.

1. How to submit a request

Law enforcement officials may submit legal requests by email to [email protected], or by mail to [PARK BENCH LABS, INC.], Attn: Legal / Law Enforcement Response, 169 Madison Ave STE 46709, New York, NY 10016.Please submit requests on official letterhead from a government email address, and include the requesting agency, the officer’s name and contact information, the specific account identifiers at issue (such as username, email, or phone number), the specific information sought, and the legal basis for the request.

2. Legal process we require

We disclose account information only when we receive valid and properly scoped legal process, consistent with applicable law:

  • Basic member information may be available with a valid subpoena.

  • Non-content records (such as transactional or log information) generally require a court order or equivalent.

  • Content of communications generally requires a valid search warrant issued on a showing of probable cause by a court of competent jurisdiction, consistent with the Stored Communications Act and other applicable law.

We review each request for legal sufficiency and may object to, narrow, or seek to quash requests that are overbroad, vague, or legally deficient. Requests from outside the United States should be submitted through applicable mutual legal assistance treaties (MLATs), letters rogatory, or other lawful channels, unless a recognized emergency applies.

3. Emergency requests

If we receive a request from law enforcement involving an emergency that presents an imminent risk of death or serious physical harm to any person, we may voluntarily disclose information we reasonably believe is necessary to prevent that harm, consistent with applicable law. Emergency requests should be clearly marked "EMERGENCY DISCLOSURE REQUEST" and describe the nature of the emergency, the person at risk, and the information needed. If you are responding to an in-progress emergency, contact local emergency services immediately (in the U.S., 911).

4. Child safety

We have a zero-tolerance policy for child sexual exploitation. Where required by law, we report suspected child sexual abuse material (CSAM) and related conduct to the National Center for Missing & Exploited Children (NCMEC), which may forward reports to law enforcement, and we cooperate with resulting investigations.

5. Human trafficking and exploitation

We prohibit human trafficking, sexual exploitation, and abuse (see our Terms and Conditions and Acceptable Use Policy). We cooperate with law enforcement investigating these crimes and may preserve and disclose information as permitted or required by law.

6. Data preservation

We will honor valid preservation requests and preserve available account records for [90] days pending receipt of valid legal process, and may extend the preservation period upon a renewed request, consistent with applicable law.

7. Notice to users

Our policy is to notify affected users of requests for their information before disclosure, so they may object, unless we are prohibited from doing so by law or court order, or where we determine in good faith that notice would be counterproductive or would create a risk to safety or to an investigation.

8. Cost reimbursement and authentication

We may seek reimbursement for costs of responding to legal process where permitted by law, and we may take reasonable steps to authenticate requests before responding.

9. No waiver

Responding to or objecting to any request is not a waiver of any legal objection or right, all of which are expressly reserved.

Privacy Policy

This Privacy Policy explains how Park Bench collects, uses, shares, and protects your personal information. By using the Service, you agree to this Policy and our Terms and Conditions.

1. Information we collect

Information you provide: 

  • Account and profile data: name, email, location (city/region/neighborhood), and profile details you choose to share.

  • Event data: events you register for or attend, and related preferences.

  • Communications: messages you send through the Service and correspondence with our support team.

  • Payment data: Card details are collected and processed by our third-party payment processor(s).

Information collected automatically: 

  • Device and usage data: IP address, device identifiers, browser type, app interactions, and log data.

  • Cookies and similar technologies (see Section 6).

  • Approximate location derived from IP or, with your permission, more precise location.

Information from third parties: 

  • Data from services you use to sign up or log in (e.g., social or single-sign-on providers), and from fraud-prevention, identity-verification, and analytics partners.

2. How we use your information

We use personal information to: operate our dating network and run our in-person events; process payments; verify identity and age; maintain safety, prevent fraud, and enforce our Terms and Acceptable Use Policy; provide customer support; communicate with you (including service and, where permitted, marketing messages); analyze and improve the Service; and comply with legal obligations.We rely on legal bases including performance of our contract with you, your consent (where required), our legitimate interests (such as safety and fraud prevention), and compliance with law.

3. How we share your information

  • With other users: your profile and the content you choose to share are visible to other users as part of the Service.

  • Service providers: vendors that host our infrastructure, process payments, verify identity, prevent fraud, provide analytics, run events, and support customers, under contractual confidentiality and data-protection obligations.

  • Safety and legal: we may disclose information to protect the safety of users or the public, enforce our policies, respond to lawful requests, and comply with law, as described in our Law Enforcement Guidelines.

  • Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this Policy.

We do not sell your personal information for money. 

4. Your choices and rights

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, to opt out of certain processing, and to withdraw consent. You can update or delete much of your profile in your account settings, or contact [email protected] to exercise your rights. We will respond as required by applicable law and will not discriminate against you for exercising your rights.Marketing: you can opt out of marketing emails using the unsubscribe link or by contacting us; we may still send service-related messages.

5. Data retention

We retain personal information for as long as your account is active and as needed to provide the Service, and thereafter as necessary to comply with legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements. When no longer needed, we delete or de-identify it.

6. Cookies and tracking

We use cookies and similar technologies to operate the Service, remember your preferences, analyze usage, and support safety and marketing. You can control cookies through your browser settings and, where offered, our cookie-preferences tool. 

7. Security

We use administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. Children

The Service is for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn we have, we will delete it.

9. International users and data transfers

We are based in the United States and process data there. If you access the Service from outside the U.S., you consent to the transfer and processing of your information in the U.S. and other countries, which may have different data-protection laws.

10. Changes to this Policy

We may update this Policy from time to time and will post the updated version with a new effective date. Material changes will be communicated as required by law.
